New Law Banning Cellphones While Driving Implemented

According to the National Safety Council, cell phone use while driving leads to 1.6 million crashes annually. Texting while driving is six times more likely to cause an accident than driving under the influence of alcohol is. One out of every four traffic crashes that occur in the U.S. are caused by cell phone usage. This startling data may be one of many reasons why a new law banning the use of cellphones while driving went into effect in Surprise this month, making it the latest city to attempt regulation rather than wait for a state effort.

Surprise officials put an ordinance banning talking, texting or anything involving a handheld communication device into effect last week, the Arizona Republic reported. Police will generally issue warnings only for the first thirty days of the new law, said Surprise police Sgt. Tim Klarkowski. After that, the fines will begin. The fine is $250 on the first offense. The law prohibits talking on a cellphone, sending a text message or otherwise using a hand-held communications device while driving in the city, unless the device is in hands-free mode.

City leaders were cautious when enacting the outright ban, fearing that it could make the city a target of the state Legislature, which has been enacting local pre-emption laws on many subjects. But Surprise Mayor Sharon Wolcott said the Arizona League of Cities and Towns believed the law could be imposed.

Lawmakers have gone back and forth on cellphone bans in cars for more than a decade. Earlier this year, legislation banning drivers’ cellphone usage was shot down gained approval in the Senate but died in the House.

The lack of a state law has led to a mishmash of different ordinances across jurisdictions. Tucson, Sedona and Oro Valley currently prohibit handheld cellphone use while behind the wheel. Meanwhile, Phoenix, Flagstaff and Fountain Hills only prohibit texting while driving.

Drivers, please make sure your cellphones are tucked away when crossing into Surprise city limits, and as always, please drive safe!

RE/MAX National Housing Report for August 2018

The RE/MAX National Housing Report for August 2018 shows increasing home prices, low inventory and a reduction in days on market. These combined factors made August 2018 the sixth time this year that home sales lagged behind last year’s pace—but only slightly at -1.1 percent. Home prices rose by 3.7 percent over August 2017, much lower than the year-over-year price increase of 5.4 percent from August 2016 to August 2017. In fact, the past three months of 2018 have trailed 2017’s rate of price growth year-over-year—compare that to four of the first five months of 2018 when year-over-year price increases easily topped those posted in 2017.

The Median Sales Price of $248,500 marked the twenty-ninth consecutive month of year-over-year price increases.

Even though active inventory dropped for the 118th consecutive month, the decline of 5.4 percent from August 2017 marked the smallest year-over-year decrease since August 2014. In addition, the August 2018 inventory drop marked the fourth consecutive month in 2018 to post single-digit percent declines, rather than the double-digit monthly drops consistently seen in early 2018 and over the previous three years.

“It varies by market, but we’re hearing that buyers are being more selective and sellers are becoming more pragmatic,” said RE/MAX CEO Adam Contos. “That dynamic could bring inventory levels up, especially in the most overheated markets, where we expect to see the clearest signs of equilibrium returning. The economy is strong and potential buyers are out there—they just need more listings, at the right price points, to consider. We believe that balance will return, which will be good for everyone in the long run. It’s just a matter of when.”

Contos added that although the lack of inventory continues to be a challenge, the trends suggest that the market finally appears to be rebalancing.

“The moderation we are experiencing seems to be a bit more than the normal seasonal lull we’d expect this time of year,” said Contos.

Don’t Fall for Package Delivery Notification Scam

Jae Herron, a Valley homeowner says she recently found a notice on her front door, implying she had missed a delivery. Like a lot of consumers, Herron likes to shop and buy online. She says getting packages dropped off at her home happens fairly frequently. So, when she came out of her front door and found a notice saying, "Sorry we missed you" from a company called "Valley Delivery," it got her attention.

But when she called the number on the notice and that's when felt something wasn't quite right. They proceeded to ask her for her date of birth and she said no. Herron says she then grew even more suspicious as the representative kept asking more personal questions, so she hung up and reported the fraud. According to the Better Business Bureau, a company by a similar name, Nu Home Promotions, was told to "modify misleading advertising practices.” Herron says she’s not surprised and wants others to be aware.

This isn’t the first time this package delivery notification scam has happened in the Valley. Earlier this year, Dave Sollis, a homeowner in Surprise said fake delivery people had been hounding him from the same company that's not actually delivering packages, but rather delivery notices aimed at data mining, according to the company's fine print. Sollis said a fake delivery man visited his home at around 5 a.m. one day, leaving a fake delivery notice. Sollis looked up Valley Delivery online and decided it wasn't a legitimate delivery company.

Valley Delivery has done business under several different names. They have a bad record with the Better Business Bureau and have been the target of past investigations looking into their shady marketing practices. 

The Better Business Bureau warns that scammers often impersonate well-known shippers or steal the identities of popular retailers to appear more legitimate. If you really did miss a delivery, the driver will leave a ticket at your door to arrange for a later delivery or for you to pick up the package. If you or someone you know has been a victim of delivery notice fraud please report the incident to the Attorney General, Better Business Bureau or contact the local, state or Federal regulators most likely to have answers to your questions here.

Sales Increase Despite Record Prices and Sinking Inventory

July home sales rose 1.8 percent year-over-year, making it the second month of 2018 to post a sales increase year-over-year, according to the RE/MAX National Housing Report. To access the housing report infographic, visit: https://rem.ax/2phKHWT.

In the July 2018 report, 37 of the report’s 54 metro areas posted sales increases over July 2017—April was the first month of 2018 where more homes were sold than the same month in 2017. The report also marks the 28th consecutive month of year-over-year price increases.

The Median Sales Price of $250,575 was up 4.4 percent from July 2017, and represents the third-highest price in report history—topped only by May and June of this year. Months Supply of Inventory was at 2.9 – the smallest total ever recorded for July.

Forty-two of the 54 metro areas reported a year-over-year drop in inventory. The Days on Market dropped to 41 – four days less than July 2017 and one day under the previous nine-year low set in June 2018.

“Because we’ve faced challenging inventories and increasing home prices for some time now, a seasonal slowdown that rebalances the market a bit might actually be a positive in the months ahead,” said RE/MAX CEO Adam Contos. “It could level affordability to some extent and create more opportunity for buyers who’ve been priced out of hot markets.”

The average Days on Market for homes sold in July 2018 was 41, down one day from the average in June 2018, and down 4 days from the July 2017 average. The number of homes for sale in July 2018 was down 0.3 percent from June 2018, and down 7.8 percent from July 2017. Based on the rate of home sales in July, the Months Supply of Inventory increased to 2.9 from 2.7 in June 2018, and decreased from 3.1 in July 2017. A 6.0-months supply indicates a market balanced equally between buyers and sellers. In July 2018, all but one of 54 metro areas surveyed reported a months supply at or less than 6.0, which is typically considered a seller’s market.

Giving back is a priority in the RE/MAX culture. All over the world, RE/MAX agents make a difference in their communities - volunteering, donating money, contributing time and ultimately changing lives.

Children’s Miracle Network Hospitals (CMN Hospitals) raises funds and awareness for 170-member hospitals that provide 32 million treatments each year to kids across the U.S. and Canada. Donations stay local to fund critical treatments and healthcare services, pediatric medical equipment and charitable care.

We are excited to announce that our offices will be participating in our fourth annual “Month of Miracles” throughout the month of August. This is a month-long fundraising event is designed to raise much-need money to support our local Phoenix Children’s Hospital as well as raise awareness in our community.

Each summer, professional home improvement scammers roam the U.S. in search of victims. Scams include everything from offering unbelievable deals that end up with hidden fees to using low-quality materials and not doing quality work. If you’re in the market for making big repairs to your home, here’s 5 ways to dodge home improvement scams according to Consumer Reports, Inc.

1.) Get recommendations. Avoid contractors that contact you unsolicited. Don’t hire a contractor based solely on an ad in a local newspaper, even if you’re offered a big discount or another incentive. Get recommendations from friends, neighbors, or relatives.

2.) See what others are saying. Before hiring a contractor, check his or her work history with your state consumer protection agency and the Better Business Bureau. Search the Web using the company or individual’s name and such words as “reviews” and “complaints.”

3.) Check credentials. Verify with your state that the contractor has the required license or registration. Some states have funds that reimburse consumers who obtain judgments against licensed contractors.

4.) Know your rights. Some states give consumers three days or so to cancel home-improvement contracts. Under federal law you have three days to cancel most contracts that are signed in your home or outside the contractor’s regular place of business.

5.) Get everything in writing. Don’t rely on spoken promises. Demand a written contract, and get all warranties in writing, too.

June 2018 RE/MAX National Housing Report

We’re already halfway through 2018 and the housing prices are at record highs, while inventory is at record lows and home sales are trailing 2017’s pace, according to the RE/MAX National Housing Report. June sales were 5.5 percent lower than June 2017 in the fifty-four metro areas surveyed, marking the seventh consecutive month of year-over-year declines.

Headed in the opposite direction, the June Median Sales Price of $258,500 was an all-time high in the nine-year history of the report. It was 5.1 percent higher than the $245,000 recorded last June, bringing the consecutive months of year-over-year price increases to 27. In each of the previous five years – going back to June 2013’s $193,750 – June has posted the highest Median Sales Price of the year.

Forty-two of the fifty-four metro areas reported a year-over-year drop in inventory. That years-long trend is reflected in Months Supply of Inventory dropping to 2.7 – down 8.8 percent year-over-year and the smallest figure ever recorded for June. Fewer houses for sale generally results in a faster process: Homes sold in June averaged just forty-two Days on Market – five days less than June 2017 and three days under the previous nine-year low of forty-five days.

“Year-over-year prices have been climbing for more than two years now, which is great news for homeowners and sellers,” said RE/MAX CEO Adam Contos. “In the hottest markets, demand is especially high because there simply aren’t that many homes for sale. The slower sales figures we’re seeing are tied to inventory more than anything else. Lack of inventory has become a theme for the year. Having fewer homes to choose from poses a challenge for buyers, who need to be ready to act decisively and quickly. Working with a full-time, professional RE/MAX agent can prepare them for that.”

3 Key Things to Do Before You Get Your Keys

After months of saving, searching, waiting, and signing paperwork you’re finally ready to unload those moving boxes and start getting settled in. But even after you close on your home, the moving frenzy can feel like an ongoing series of to-do lists to no end. And though it’s tempting to take it easy and start arranging your furniture and hanging curtains the minute you get the keys to your new home, stop and remember the 3 key things to do before you get your keys.

1.) Change the locks: Before you even so much as drop one box into your lovely new domicile, be sure to change the locks or have them rekeyed. You never know who may have a copy of the original keys and it’s better to be safe than sorry. You can pick up locksets at your local home improvement store and they are relatively easy to install yourselves.

2.) Locate the circuit breaker: Doesn’t sound super important, but locating the circuit breaker in your new home is one of the first things you should do prior to move in. There’s nothing worse than having a power outage during a move that leaves you struggling to find the breaker. Even if electrical testing during your home inspection went well, it still doesn’t hurt to know where your electric box and switches are. It’s also a good idea to label your switches clearly in case of emergency if they aren’t labeled already.

3.) Change the alarm batteries: It’s likely your fire alarm and carbon monoxide detectors were tested during the home inspection process of your home buying experience. But making sure your alarms have fresh batteries will benefit you in the long run. In the shuffle of moving in and getting settled in, it’s an easy step to forget that could save lives later.
